These Terms and Conditions set out the basis on which we provide waste disposal and waste collection services in Shepherds Bush and surrounding areas. By making a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any services.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual or business that requests or receives waste disposal services from us.
Services means the collection, removal, transportation and disposal of waste as agreed with the Customer.
Booking means a confirmed order for Services made by the Customer via telephone, email, online form or any other method accepted by us.
Waste means items, materials or substances presented by the Customer for collection and disposal, including household waste, commercial waste, garden waste and bulky items, but excluding any prohibited or hazardous materials as set out in these Terms and Conditions and applicable waste regulations.
We provide waste collection and disposal services primarily within Shepherds Bush and nearby districts. The exact scope and availability of the Services may vary according to location, type and quantity of waste, access conditions and time of booking. We reserve the right to refuse any Booking that falls outside our normal service area or capacity.
The Services may include one-off waste collections, regular waste collections, bulky item removal, garden waste removal, and similar waste disposal services, as agreed with the Customer at the time of Booking.
3.1 To request Services, the Customer must contact us via the communication methods we make available and provide accurate details of the waste to be collected, including approximate volume, type of waste, address in or around Shepherds Bush, and preferred collection date and time.
3.2 A Booking is only confirmed when we have accepted the Customer's request, provided a price estimate or fixed quotation, and agreed a collection date and time. We may confirm a Booking verbally, in writing or electronically.
3.3 Any quotation is based on the information provided by the Customer. If, upon arrival, the waste differs materially in type, volume or weight from that described, or if access is more difficult than advised, we reserve the right to amend the price or refuse to carry out all or part of the Services.
3.4 The Customer is responsible for ensuring that the access to the collection point is safe and suitable for our staff and any vehicles, and for obtaining any necessary permissions to access shared areas, private roads or restricted zones.
4.1 Our Services are intended for Customers based in Shepherds Bush and surrounding neighbourhoods. We may, at our discretion, accept Bookings outside this area, subject to additional charges or different terms.
4.2 The Customer must provide clear instructions on the collection location, including any specific access codes, parking arrangements or building entry requirements. If we are unable to gain safe access within a reasonable period of arrival due to incorrect information or lack of permissions, this may be treated as a late cancellation and charges may apply.
4.3 We are not responsible for delays in performance of the Services caused by traffic, parking restrictions, road closures or other circumstances beyond our reasonable control, particularly within busy or restricted streets in and around Shepherds Bush.
5.1 The Customer is responsible for ensuring that:
a. All waste to be collected is clearly identified and separated from items that are not to be removed.
b. Waste is presented in a safe manner, with sharp, fragile or heavy items appropriately contained or secured.
c. No prohibited or hazardous materials are included in the waste unless this has been specifically agreed in writing in compliance with applicable regulations.
d. The collection point is accessible and not obstructed by parked vehicles, locked gates or other obstacles at the agreed collection time.
5.2 The Customer must inform us in advance if any special handling is required, for example for heavy items, waste stored at height, or difficult access such as narrow stairways or basements.
6.1 We operate in compliance with applicable UK waste management legislation and regulations. All waste collected will be transported and disposed of only at authorised facilities, and we will take reasonable steps to maximise recycling and responsible waste processing.
6.2 The Customer must not present for collection any waste that is prohibited under relevant regulations, including but not limited to:
a. Certain hazardous materials such as chemicals, solvents, paints, oils and asbestos, unless specifically agreed and arranged in compliance with law.
b. Medical, clinical or biological waste.
c. Pressurised containers or gas cylinders, unless agreed.
d. Explosive or highly flammable materials.
6.3 If we discover prohibited or hazardous materials mixed with the waste, we may refuse to collect part or all of the waste, or we may remove it and charge an additional fee to cover specialist handling, transportation and disposal, as required by law.
6.4 The Customer is responsible for any costs, fines or penalties that arise as a result of failure to comply with waste regulations, where such failure is due to the Customer's actions or omissions, including misdescription of waste presented for collection.
7.1 Prices for the Services will be communicated to the Customer at the time of Booking, based on the type and estimated volume or weight of waste, the service area, and any additional requirements such as urgent collections or difficult access.
7.2 We may charge by volume, weight, item, load size or a combination of these methods. Any prices quoted are exclusive of applicable taxes unless stated otherwise.
7.3 Unless agreed otherwise, payment is due on completion of the Services. We may, at our discretion, require a deposit or full payment in advance, particularly for larger collections, commercial Customers or regular service agreements.
7.4 We accept payment by methods notified to the Customer at the time of Booking. All payments must be made in pounds sterling. If payment is not received when due, we reserve the right to charge interest on overdue amounts and to suspend or cancel any further Services.
8.1 The Customer may cancel or amend a Booking by contacting us as soon as possible. Any cancellation or change is only effective once we have acknowledged it.
8.2 If the Customer cancels more than 24 hours before the agreed collection time, no cancellation fee will ordinarily be charged, unless a specific non-refundable element has been agreed for that Booking.
8.3 If the Customer cancels less than 24 hours before the agreed collection time, or if we attend the location in or near Shepherds Bush at the agreed time and are unable to carry out the Services due to the Customer's act or omission, we may charge a cancellation fee or a call-out charge to cover our costs.
8.4 If the Customer wishes to increase or decrease the amount of waste to be collected, or to change the service date or address, this may affect the price and availability of the Services. We will use reasonable endeavours to accommodate such changes but are not obliged to do so.
9.1 We will endeavour to perform the Services on the agreed date and within the agreed time window, but any times given are estimates only and are not guaranteed. We are not liable for minor delays or failure to perform due to factors beyond our reasonable control.
9.2 Upon arrival, our staff will assess the waste and confirm that it matches the description given at the time of Booking. If there is a significant discrepancy, we may revise the price or refuse the Service in whole or in part.
9.3 Once waste has been removed from the Customer's premises or collection point, legal ownership and responsibility for the waste transfers to us, and we will manage the waste in accordance with applicable waste regulations.
10.1 We will exercise reasonable care and skill in providing the Services. However, we accept liability only to the extent set out in this section and as required by law.
10.2 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter in respect of which liability cannot lawfully be limited or excluded.
10.3 Subject to the above, we will not be liable for:
a. Any loss of profits, loss of business, loss of revenue, or loss of anticipated savings.
b. Any indirect or consequential loss or damage.
c. Damage caused by defective or unsafe premises, access routes or items that were already damaged or fragile before the Services commenced.
10.4 If we damage property while performing the Services and such damage is directly caused by our negligence, we may choose to repair the damage or compensate the Customer for the reasonable cost of repair or replacement, provided the Customer notifies us promptly and gives us an opportunity to inspect the damage.
10.5 Our total liability for all claims arising out of or in connection with a particular Booking will not exceed the total amount paid by the Customer for that Booking, except where a higher limit is required by law.
The Customer agrees to indemnify and hold us harmless from and against any claims, costs, damages, fines or expenses arising from the Customer's breach of these Terms and Conditions, including but not limited to the presentation of prohibited or hazardous waste without proper disclosure or consents, or the provision of inaccurate information about the waste or access conditions.
We maintain appropriate insurance cover in connection with the provision of waste disposal services. Details of our insurance can be provided upon reasonable request. Our insurance does not cover items that we were expressly instructed not to remove or areas of the property unrelated to our work.
13.1 If the Customer has any concerns or complaints about the Services provided, they should contact us as soon as possible, providing full details of the issue and any supporting information.
13.2 We will investigate complaints in a fair and timely manner and will endeavour to resolve them by agreement with the Customer. Our internal complaints process does not affect the Customer's statutory rights.
14.1 We may collect and process personal data about Customers in order to manage Bookings, provide the Services and administer payments.
14.2 We will handle personal data in accordance with applicable UK data protection laws. We will not sell personal information to third parties and will only share data with third parties where necessary to perform the Services or comply with legal obligations.
15.1 We may amend these Terms and Conditions from time to time. The version in force at the time of a Booking will apply to that Booking.
15.2 Any changes will generally be published or made available to Customers on request. Continued use of our Services after any amendments take effect constitutes acceptance of the revised Terms and Conditions.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be severed from the remaining provisions, which will continue in full force and effect.
These Terms and Conditions, together with any written quotation or confirmation of Booking, constitute the entire agreement between us and the Customer in relation to the relevant Services and supersede any prior discussions, correspondence or representations.
18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of England and Wales.
18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services.
By making a Booking for waste disposal or waste collection services in Shepherds Bush or surrounding areas, the Customer confirms that they have read, understood and agree to these Terms and Conditions.
